Policy Implementing the NCAA Policy on Campus Sexual Violence

1.0 Policy Purpose

This policy specifies the protocols and associated responsibilities required to implement the NCAA Board of Governor’s Policy on Campus Sexual Violence.

2.0 To Whom the Policy Applies

This policy applies to all current varsity student-athletes, prospective varsity student-athletes supported and/or admitted by the admission process, and all individuals who participate in the recruitment, admission, Title IX-related education, or conduct processes for current and/or prospective student-athletes.

3.0 Policy Statement

Brown University requires that:

  • The Division of Athletics and Recreation is informed on, integrated in, and compliant with University policies and processes regarding Sexual Violence prevention and proper adjudication and resolution of acts of Sexual and Interpersonal Violence.
  • University policies and processes regarding Sexual Violence prevention and adjudication, and the name and contact information for the Title IX Coordinator, are readily available within the Division of Athletics and Recreation and are provided to varsity student-athletes.
  • All varsity student-athletes, coaches, and staff are educated each year on Sexual Violence prevention and response.
  • All incoming, continuing, and transfer varsity student-athletes complete an annual disclosure related to their conduct that resulted in discipline through a Title IX proceeding or in a criminal conviction for Sexual, Interpersonal, or Other Acts of Violence. Transfer varsity student-athletes must also disclose whether a Title IX proceeding was incomplete at the time of transfer.
  • The University takes reasonable steps to confirm whether incoming, continuing, or transfer varsity student-athletes have been disciplined through a Title IX proceeding or criminally convicted of Sexual, Interpersonal or Other Acts of Violence. In a manner consistent with federal and state law, the University must share relevant discipline information and incomplete Title IX proceedings as a result of transfer with other NCAA member institutions when a student attempts to enroll in a new college or university.
  • The University, when choosing to recruit and/or accept an incoming or transfer varsity student-athlete, follows the written procedure that directs its staff to gather information that reasonably yields information from the former institution(s) to put University leadership on notice that the student left the previous institution with an incomplete Title IX proceeding, was disciplined through a Title IX proceeding, or has a criminal conviction for Sexual, Interpersonal or Other Acts of Violence.
  • The Division of Athletics will cooperate in University investigations involving reports and matters related to Sexual and Interpersonal Violence where allegations pertain to varsity student-athletes and Division of Athletics and Recreation staff in a manner compliant with University policies for all students.

Brown’s responsible officers will attest annually that the University complies with these requirements.

3.1 Disclosures During Recruitment

Varsity sport coaches will verbally inquire about misconduct of prospective varsity student-athletes during the pre-application recruiting process, including that related to Sexual and Interpersonal Violence.

3.1.1 Positive Disclosures

Positive disclosures will be referred internally to the head coach and/or assigned sport administrator. Division of Athletics and Recreation leadership will decide whether to move forward with recruitment. If moving forward, the disclosed information will be shared with Office of Admission personnel as part of the pre-read process.

3.2 Disclosures Following Application

For prospective varsity student-athletes and transfer student-athletes supported via the admission process, a written disclosure will be required following the close of application submission periods (e.g., early decision, regular decision, or transfer deadlines). Positive disclosures will be referred to the appropriate University office specified below. Concurrently, the Division of Athletics and Recreation leadership will determine whether, after reviewing the disclosed information, the applicant, if admitted, will be allowed to become a member of the respective varsity program.

3.2.1 Positive Disclosures (Non-Criminal)

Positive non-criminal disclosures will be referred to the Office of College Admission and/or other appropriate University offices (e.g., Title IX & Gender Equity Office, Office of Student Conduct & Community Standards, etc.), which may contact the former institution to request more information about the matter disclosed prior to reviewing and rendering a final admission decision.

3.2.2 Positive Disclosures (Criminal)

Positive criminal disclosures will be referred to the Department of Public Safety, which may request additional information from appropriate sources. The acquired information will be shared with the Office of College Admission, the Office of the Dean of Students, and Division of Athletics and Recreation for review prior to rendering a final admission decision and/or determining whether, if admitted, the applicant will be allowed to become a member of the respective varsity program.

3.3 Annual Preparticipation Disclosures

On an annual basis, a written disclosure will be required for all varsity student-athletes prior to participation in athletics activities during the respective academic year. Positive disclosures will be referred to the appropriate University office, which will address the matter in accordance with applicable University policies and procedures. Additionally, Division of Athletics and Recreation leadership will review positive disclosures to determine whether the conduct violates the student-athlete code of conduct and/or impacts participation as a varsity student-athlete.

3.3.1 Positive Disclosures (Non-Criminal)

Positive non-criminal disclosures will be referred to the appropriate University offices (e.g., Title IX & Gender Equity Office, Office of Student Conduct & Community Standards, etc.), which may review the disclosure to determine what follow-up action and/or proceedings may be necessary.

3.3.2 Positive Disclosures (Criminal)

Positive criminal disclosures will be referred to the Department of Public Safety, which may request additional information from appropriate sources. The acquired information will be shared with the appropriate University offices (e.g., Title IX & Gender Equity Office, Office of Student Conduct & Community Standards, etc.) and the Division of Athletics and Recreation, which may review the disclosure to determine what follow-up action and/or proceedings may be necessary.

4.0 Definitions

For the purpose of this policy, the terms below have the following definitions:

Interpersonal Violence: Violence that is predominantly caused due to the relationship between the victim and the perpetrator, including dating and domestic violence.

Other Acts of Violence: Crimes including murder, manslaughter, aggravated assault or any assault that employs the use of a deadly weapon or causes serious bodily injury.

Sexual Violence: A term used to include both forcible and nonforcible sex offenses, ranging from sexual battery to rape.

5.0 Responsibilities

All individuals to whom this policy applies are responsible for becoming familiar with and following this policy. University supervisors and employees with student oversight duties are responsible for promoting the understanding of this policy and for taking appropriate steps to help ensure and enforce compliance with it.

Office of College Admission: Make all final decisions regarding admission of applicants.

Office of Institutional Equity and Diversity: Provide training, coordinate applicable policies, and review all positive disclosures.

Division of Athletics and Recreation: Determine whether to proceed with recruitment and/or offer varsity team membership to prospective student-athletes.

6.0 Consequences for Violating this Policy

Failure to comply with this and related policies is subject to disciplinary action, up to and including suspension without pay, or termination of employment or association with the University, in accordance with applicable (e.g., staff, faculty, student) disciplinary procedures.

Failure to comply with this policy is also subject to review by the NCAA Board of Governors followed by publication of failure on the NCAA website.
